INFORMATION FOR BUSINESS PARTNERS ON THE PROCESSING OF PERSONAL DATA

  1. Personal Data Administrator

The administrator is a business company that deals with business and marketing strategies, planning and management, production of marketing activities and activities.

 

  1. Categories of personal data processed

In connection with its business activities, the personal data controller processes the following categories of personal data of business partners (or third parties, eg employees of business partners): personal identification data (eg name and surname, date of birth, ID number, VAT number, etc.); contact details (eg address, e-mail, telephone);

 

III. Purposes of personal data processingThe purpose, ie the reason why the administrator processes personal data of business partners, are:• submitting proposals for concluding a contract• fulfillment of contractual obligations• improving the quality of services• processing requests from business partners sent by e-mail or telephone

  1. Legal basis for the processing of personal data

The personal data controller processes the personal data of business partners, as this is necessary for reasons of performance of the contract (eg contracts for purchase, work, or mediation) and fulfilment of legal obligations, especially accounting and tax. The administrator does not process personal data on the basis of consent. V. Recipients of personal data Recipients of personal data of business partners can be: a personal data controller as a service provider; public authorities; processors on the basis of written contracts for the processing of personal data concluded in accordance with the Regulation.

  1. Time of processing personal data

The personal data of business partners is processed by the personal data controller for the period specified in the relevant legal regulations or for the period during which the contractual relationship between the personal data controller and the business partner will last. In justified cases, the controller is entitled to process personal data even after the termination of the contractual relationship, in order to ensure the protection of its rights and legitimate interests for a maximum of ten years from the termination of cooperation (referring to the limitation period. 89/2012 Coll., Civil Code, as amended), or in order to comply with the requirements of a special act, eg Act No. 499/2004 Coll., on archiving and the file service, as amended.

 

VII. Rights of business partners

Business partners have the following rights against the administrator in connection with their personal data:

  • the right of access to personal data
  • the right to correct inaccurate data
  • the right to delete personal data, which, however, only applies to personal data that the controller processes for purposes other than the performance of the contract. The data processed for the purpose of fulfilling the contract may not be deleted by the administrator
  • the right to restrict processing if the business partner:
  • denies the accuracy of personal data for the time necessary to verify the accuracy of personal data
    • rejects the deletion of unlawfully processed personal data and instead calls for restrictions on their use
  • requests data to identify, enforce or defend legal claims and the administrator no longer needs them
  • objected to the processing set out below until it has been verified that the processing is justified or not. whether the legitimate interests of the controller for processing outweigh the interests of the business partner
  • the right to be notified of a correction, deletion or restriction of processing
  • the right to data portability, which, however, can only be used with regard to those data that the controller processes automatically on the basis of consent or a contract with a business partner.
  • the right to object to the processing of personal data, which the business partner may raise on the contact details of the controller (see above)
  • the right to withdraw consent to the processing of personal data
  • the right to lodge a complaint with the supervisory authority, if the business partner considers that the processing of personal data violates personal data protection legislation.

The complaint can be filed with the Office for Personal Data Protection, Lt. Col. Sochora 27, 170 00 Prague 7, www.uoou.cz.

 

VIII. Lessons for business partners

The personal data controller must know the personal data of business partners and process them, otherwise he would not be able to provide the agreed services. For this reason, business partners are obliged to provide personal data at the request or request of the personal data controller. Failure to provide personal data will mean that the personal data controller will not be able to enter into a contractual relationship with the business partner at all, resp. will not provide any performance.
